These Terms and Conditions (“Terms”) govern your access to and use of Idamkadam.lk (the “Platform”), including any related pages, tools, and services provided through it.

Please read these Terms carefully before using the Platform. By using, registering, posting Ads, or purchasing any paid service on Idamkadam.lk, you agree to be legally bound by these Terms.

1) Platform Operator and Contact Details

2) Acceptance of These Terms

By accessing, browsing, registering an account, posting an advertisement (“Ad”), purchasing a package, purchasing a boost, or otherwise using any part of the Platform, you confirm that you:

  • have read and understood these Terms, and
  • agree to be legally bound by them.

If you do not agree, you must not use the Platform.

3) Eligibility (Age and Capacity)

  • You must be at least 18 years old to register, purchase services, or post Ads on the Platform.
  • Users under 18 are not permitted to register or use paid services.
  • By using the Platform, you represent that you have the legal capacity to enter into a binding contract under Sri Lankan law.

4) Changes to These Terms

We may update these Terms from time to time to reflect operational, legal, or service changes.

  • Updated Terms will be communicated by email (and/or via other communication methods described in these Terms).
  • Unless stated otherwise, updated Terms become effective on the date stated in the notice or the “Last Updated” date on the Terms page.
  • Your continued use of the Platform after the effective date means you accept the updated Terms.

Effective from: 1 February 2026

5) Definitions

For clarity and dispute prevention, the following definitions apply:

  • “Platform” means Idamkadam.lk and its services, systems, tools, and pages.
  • “Operator”, “we”, “us”, “our” means HARITHA HOMES (PRIVATE) LIMITED.
  • “User” means any person who accesses or uses the Platform, including Visitors and Advertisers.
  • “Visitor” means a person who browses the Platform without posting Ads or purchasing services.
  • “Advertiser” means a User who posts Ads and/or purchases paid services.
  • “Ad” / “Listing” means any advertisement, property listing, content, or listing data submitted to the Platform.
  • “Package” means an advertisement publishing plan purchased to publish an Ad for a defined duration and benefits.
  • “Boost” / “Boost Package” means a paid visibility enhancement for an Ad for a defined boost duration.
  • “Paid Services” means any paid feature including publishing packages, boost packages, and any related add-ons offered on the Platform.
  • “Transaction” means any payment attempt, authorization, or payment made for Paid Services.
  • “Payment Gateway” means the third-party payment service provider used for payment processing (currently Marx Payments).
  • “Service Delivery” means the performance of Paid Services by the Platform (for example: Ad publication, ad approval/publishing status change, boost activation, visibility placement, and/or processing social posting where included).
  • “Content” means any text, images, video, links, contact details, descriptions, or other material submitted by a User.
  • “Prohibited Content” means content that violates these Terms, any policy, or any applicable law.
  • “Account” means a registered user profile on the Platform.

6) Electronic Transactions and Electronic Records (Sri Lanka)

6.1 Formation of Contracts Electronically

You agree that agreements and transactions made through the Platform are formed electronically. Actions such as clicking buttons, submitting forms, confirming purchases, and completing payments may constitute your acceptance and agreement.

6.2 Consent to Electronic Communications

You consent to receive communications and notices electronically, including via:

  • email,
  • SMS,
  • WhatsApp,
  • Platform notifications,
  • and other electronic means we use for service and legal notices.
6.3 Electronic Records as Evidence

You agree that, to the maximum extent permitted by law:

  • Platform records (including system logs, timestamps, transaction records, payment receipts, order references, and status changes) may be used as evidence of transactions and service delivery.
  • Platform records may be relied upon to resolve disputes, including disputes relating to payments, chargebacks, and service delivery.
6.4 Server Time

Unless stated otherwise, the Platform’s records and timestamps are measured using the Platform server time (generally Sri Lanka time). This time will be used for determining service periods, expiry, and deadlines.

Note: This section is intended to align Platform transactions with the Sri Lankan Electronic Transactions Act, No. 19 of 2006 and support transaction evidence where required.

7) Account Registration, Authentication, and Security

7.1 Registration Methods

Users may register and login via:

  • Phone number authentication,
  • Email authentication,
  • Google authentication.
7.2 Responsibility for Account Security

You are responsible for:

  • keeping your login credentials secure,
  • preventing unauthorized access to your account,
  • promptly notifying us if you suspect unauthorized access or misuse.

You are responsible for all activity performed under your account unless we determine there was a Platform security breach.

7.3 Account Ownership and Identity

The Platform may treat the verified phone number and/or email associated with an account as the primary identifier of the account owner.

7.4 Account Suspension/Restriction

We may restrict, suspend, or terminate accounts where we reasonably suspect:

  • fraud, abuse, or illegal activity,
  • repeated policy violations,
  • misuse of payments, chargebacks, or payment disputes,
  • threats to Platform security or integrity.

8) User Profile Rules and Account Actions

8.1 Accuracy of Profile Information

You agree that the profile information you provide (e.g., name, phone number, email, WhatsApp number) must be accurate, lawful, and not misleading.

8.2 Email Change for Google‑Auth Accounts

If you signed up using Google authentication, you may be required to set a password before changing your email address to maintain account security.

8.3 Account Deletion

If you delete your account (or request account deletion):

  • your Ads associated with the account may be deleted or removed from public view,
  • your bookmarks/favorites may be removed,
  • you may lose access to paid features and account history.

Refund eligibility and refund processing for purchases linked to an account deletion are governed by the Refund/Return Policy.

9) Ads, Listings, and Content Rules

9.1 Your Responsibility for Ads

As an Advertiser, you are solely responsible for your Ads and Content. You must ensure:

  • the Ad is truthful, accurate, and not misleading,
  • you have legal authority to advertise the property (ownership or proper authorization),
  • the listing complies with applicable laws and regulations.

We do not guarantee the accuracy of Ads posted by Users and do not act as a real estate broker/agent unless explicitly stated.

9.2 Prohibited Content and Activities

You must not post Ads or content that includes or promotes:

  • fraud, scams, or misleading information,
  • illegal goods/services or unlawful property activity,
  • hateful, harassing, abusive, threatening, or discriminatory content,
  • explicit adult services or prohibited sexual content,
  • copyrighted images or text without permission,
  • impersonation or false identity,
  • any content that violates applicable law or infringes third-party rights.
9.3 Content and Media Rules
  • You must only upload images you own or have permission to use.
  • You must not upload content designed to mislead Users (e.g., fake photos, stolen photos, deceptive watermarks).
  • If the Platform enforces content formatting rules (e.g., no contact details in images), you must comply with them.
9.4 Moderation and Right to Remove

We may review, reject, disable, edit (for formatting), or remove any Ad or Content if:

  • it violates these Terms or policies,
  • it is required by law, legal request, or regulatory authority,
  • it poses risk to users, the Platform, or payment integrity,
  • we reasonably suspect fraud or abuse.

Approval does not mean we endorse the listing, and we may later change status if new violations are found.

10) Paid Services (Packages, Boosts) and Service Delivery Proof

10.1 What You Are Purchasing

Depending on what you buy, Paid Services may include:

  • publishing a listing on the Platform for a defined duration and benefits,
  • boosting a listing’s visibility for a defined boost duration,
  • optional inclusion of posting/marketing on social media platforms where specified in the purchased package.
10.2 When Service Delivery Occurs

For chargeback and dispute clarity, you acknowledge that service delivery occurs when one or more of the following happens (as applicable):

  • Ad Publishing Package Delivery: Your Ad becomes published/approved on the Platform and is displayed according to the purchased plan’s duration and visibility features.
  • Boost Package Delivery: Boost status is applied to your Ad (e.g., boosted placement, “boosted” flag, or boosted exposure features) for the boost duration purchased.
  • Social Media Posting (if included): We process and/or publish the Ad to the relevant external platform(s), or record it as scheduled/processed within our operational workflow.
10.3 Evidence We May Provide for Payment Disputes

To respond to payment disputes and chargebacks, you agree that we may use and provide evidence such as:

  • payment transaction details (amount, transaction references, gateway records),
  • Ad ID, package or boost details purchased,
  • timestamps of order creation, status updates, approval and publication,
  • logs confirming boost activation, ad visibility placement, and service actions,
  • email notifications sent,
  • platform screenshots and internal audit records,
  • social media posting logs (where applicable).
10.4 Availability and Maintenance

We aim to keep the Platform available; however, you acknowledge that temporary downtime, routine maintenance, or technical issues may occur. Minor interruptions do not necessarily mean non-delivery of services.

11) Payments and Payment Gateway (Marx Payments)

11.1 Payment Provider

Payments are processed through a third-party payment gateway (currently Marx Payments). You understand that the payment gateway is responsible for payment processing and authorization.

11.2 No Card Storage / No Recurring Payments
  • We do not store your full card details on the Platform.
  • We do not support recurring payments (unless explicitly introduced later with clear notice and consent).
  • Each purchase is a one-time payment.
11.3 User Authorization and Correct Details

You are responsible for ensuring:

  • you are authorized to use the selected payment method,
  • payment details you submit are correct,
  • the payment is not fraudulent or unauthorized.
11.4 Fraud Prevention and Holds

We may delay, hold, cancel, or investigate a transaction if we reasonably suspect fraud, misuse, or abnormal activity.

12) Refunds, Cancellations, and Chargebacks (Summary)

Refunds and cancellations are governed by our Refund/Return Policy, which forms part of the Platform’s legal policies.

Key summary (not replacing the Refund/Return Policy):

  • Refund requests may be considered within 7 days after payment (subject to eligibility and verification).
  • Where approved, refunds will be processed to the original payment method used for the transaction.
  • Refund processing may take up to 5 working days after approval (or as required by banking/payment systems).
Chargebacks
  • We may dispute the chargeback using Platform records and evidence of service delivery (see Section 10).
  • We may restrict the related account where necessary to prevent fraud or repeated abuse.
  • We recommend contacting our support first to resolve the issue quickly.

13) Editing Limits and Admin Discretion

  • Ads can be edited only up to the edit limit included in the purchased ad publishing package.
  • Users may request additional edits. The Platform (Admin/Operator) may approve or reject such requests at its discretion.
  • Excessive or abusive edit requests may be denied.

14) Social Media Posting Limitation (If Included)

If your package includes social media posting:

  • Posting your Ad to external platforms may be handled manually or via Platform tools.
  • Deleting an Ad on Idamkadam.lk does not automatically remove that Ad from social media platforms.
  • To remove a social media post, you must submit a manual request via WhatsApp, call, or email (until an automatic option is released in a future version).

We are not responsible for delays or limitations caused by third-party social media platforms.

15) Ad Expiry and Non‑Reactivation

  • Each Ad has a defined duration based on the purchased package.
  • After the Ad duration ends, the Ad will be made inactive automatically.
  • Expired Ads cannot be reactivated. To list again, you must publish a new Ad and purchase the applicable package again.

16) User Conduct and Prohibited Misuse

You must not:

  • scrape, crawl, or use bots to extract Platform data without permission,
  • reverse engineer or attempt to break Platform security,
  • manipulate views, clicks, ranking, or boosted placements,
  • spam, harass, or abuse other users,
  • upload viruses or malicious scripts,
  • attempt to bypass Platform payment systems or rules.

We may suspend accounts and take legal action where necessary.

17) Intellectual Property

17.1 Platform IP

All Platform branding, design, layout, UI, software, and content owned by the Operator are protected by intellectual property laws. You may not copy, reproduce, or use them without written permission.

17.2 Your Content License to Us

By posting content on the Platform, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your content only as necessary to operate, promote, and provide the Platform services.

18) Disclaimers (Classified Marketplace Standard)

  • The Platform acts as an intermediary for listing display and visibility.
  • We do not guarantee successful sale, rent, lease, booking, lead generation, or outcomes from Ads.
  • Users are responsible for due diligence before entering into any transaction with other users.
  • We do not verify ownership, title, permits, or claims unless explicitly stated.

19) Limitation of Liability

To the maximum extent permitted by law:

  • we are not liable for indirect, incidental, special, punitive, or consequential losses,
  • we are not liable for disputes between users, property issues, third-party claims, or external platform actions,
  • our total liability for any claim related to paid services will be limited to the amount you paid for the specific service giving rise to the claim (or a reasonable cap as permitted by law).

Some legal rights may not be excluded under applicable law; in such cases, our liability is limited to the maximum extent permitted.

20) Indemnity

You agree to indemnify and hold harmless the Operator, its directors, employees, and agents against any claims, losses, damages, liabilities, and expenses arising from:

  • your Ads and content,
  • your violation of these Terms,
  • your violation of laws or third-party rights,
  • disputes arising from your listing or communications with other users.

21) Suspension and Termination

We may suspend or terminate access to the Platform (fully or partially) for:

  • fraud, illegal activity, or payment abuse,
  • repeated policy breaches,
  • legal requests or compliance requirements,
  • threats to Platform security.

Upon termination, your Ads may be removed or disabled, and you may lose access to services.

22) Notices and Communications

We may send notices and communications to you via:

  • email,
  • SMS,
  • WhatsApp,
  • and/or Platform notifications.

Notices sent to your registered email/phone are considered delivered when sent, subject to applicable law.

23) Governing Law and Dispute Resolution

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka.

Disputes should first be attempted to be resolved by contacting support. If unresolved, disputes may be subject to the jurisdiction of the courts of Sri Lanka.

24) General Provisions

  • Severability: If any part of these Terms is found invalid, the rest remains effective.
  • No Waiver: Failure to enforce a term does not waive our right to enforce it later.
  • Assignment: We may assign our rights and obligations under these Terms as part of business operations or restructuring.
  • Entire Agreement: These Terms, together with the Privacy Policy and Refund/Return Policy, form the complete agreement between you and the Operator regarding Platform use.
